SUBJECT: ANNUAL OFFENCE DECLARATION (ONTARIO REGULATION 521/01)


The Safe Schools Act 2000 was introduced to ensure a safe environment for students and staff. Under Regulation, 521/01 of this Act, all school boards were required to collect criminal background checks on all staff by July 31, 2003. Additionally, under the same Regulation 521/01, school boards in Ontario are required to collect Offence Declarations from all staff on an annual basis.


In order to comply with Regulation 521/01, all employees must complete and submit an Offence Declaration form (attached) on an annual basis. In order to complete the process, all employees are required to:

• Complete/verify the personal information (name, date of birth) on the form as required
• check the appropriate box on their form;
• provide details where necessary;
• sign the Offence Declaration form;
• return the form in a sealed envolope to the attention of Manager of Employee Services
• return the completed form to the Manager of Human Resources no later than June 5, 2009.

Those employees who have had a conviction for an offence under the Criminal Code of Canada since completion of their last criminal background check will have their situations reviewed in a confidential manner by the Manager of Employee Services as set out in Board Policy # 818 with due regard for individual circumstances, including their employment with the Board, the seriousness of the criminal offence(s) and the relevance of the offence(s) to their employment with the Board.

A list of common questions/answers regarding offence declarations is posted on the Board website at www.tbcdsb.on.ca under the Human Resources Department menu.

The information in this memorandum has been communicated to the Federations, Unions, and Employee Representatives.
